Acceptable Use Policy

1. Purpose

This Acceptable Use Policy (“AUP”) governs how you may use The Operator's Brief and its outputs, including reports, benchmarks, pricing data, and other documentation (collectively, “Service Data”). This AUP is incorporated into and supplements our Terms of Service.

2. Permitted Use

You may use Service Data solely for your own internal business purposes, including:

  • Setting and adjusting your company's pricing strategy
  • Internal competitive analysis and market positioning
  • Business planning and revenue forecasting
  • Training your own staff on market conditions

Use is limited to the individual business entity associated with your subscription account.

3. Prohibited Use

You may not, under any circumstances:

  • Resell, sublicense, or redistribute any Service Data, in whole or in part, whether for free or for compensation
  • Repackage or create derivative works from Service Data for distribution to any third party
  • Share, forward, publish, or post reports, benchmarks, or pricing data in any public or semi-public forum, including social media, industry groups, trade publications, or online communities
  • Use Service Data for marketing, advertising, audience segmentation, or lead generation — including using pricing intelligence to target competitors' customers or to create marketing materials referencing competitor pricing
  • Provide access to the Service or Service Data to any individual or entity not authorized under your subscription
  • Scrape, crawl, or systematically extract data from the Service through automated means
  • Reverse-engineer our methodology, algorithms, data models, or scoring systems
  • Misrepresent Service Data as your own original research or analysis
  • Use Service Data to harm competitors through deceptive or unfair business practices

4. Account Sharing

Your subscription is for a single business entity. You may not share login credentials with individuals outside your organization. If multiple locations or subsidiaries need access, each must maintain a separate subscription.

5. Data Integrity

When providing data to the Service (pricing, truck counts, service mix), you agree to provide accurate and current information to the best of your knowledge. Deliberately providing false or misleading data to manipulate benchmarks or gain unfair advantage is a violation of this policy.

6. System Integrity

You may not:

  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Introduce malware, viruses, or other harmful code
  • Interfere with or disrupt the Service or its servers and networks
  • Circumvent or attempt to circumvent access controls, rate limits, or security measures

7. Enforcement

Violations of this AUP may result in:

  • Warning: For minor or first-time violations, we may issue a written warning with a cure period.
  • Suspension: Repeated or serious violations may result in temporary suspension of your account.
  • Termination: Material violations — including any resale, redistribution, or marketing use of Service Data — are grounds for immediate termination without refund.
  • Legal Action: We reserve the right to pursue legal remedies, including injunctive relief and damages, for violations that cause harm to our business or other subscribers.

8. Reporting Violations

If you become aware of any unauthorized use or distribution of Service Data, please report it to compliance@thepricegap.com. We take all reports seriously and investigate promptly.

9. Changes to This Policy

We may update this AUP from time to time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of the Service after the effective date constitutes acceptance.
